I wonder if it was stupid officials that used that term or a stupid "reporter".

Apparently later in the article Fox said he was trespassing.
 
Metra Police caught late teens/early twenty-somethings doing a photo shoot at the Van Buren Street Station - on the tracks - this summer. Their second question was "you know trains are running on these tracks, right?" - after "hi, what are you doing?"
