Reports on the NEC Railfan page on Facebook indicate there was a railroad tie on the tracks (possibly put there by kids playing a prank) that was hit by 80 and flew up into the windshield of 79, breaking through the glass and injuring the engineer (not seriously).
 
Hate the that it happened here is couple things to improve and learn from this.

1.we have teach adult/kids more about railroad safety, try to find who and go after them & sue them/parents charge them $100 passenger on board and ones planned to board 79 to pay passengers back & $100/4,000total, per hour that it was late by the way didn't get into Charlotte until around 3a that would be $600 for that,plus $400 for all the extra crews, All total $5,000.

2. Ncdot drop the ball on this one, they should ran extra Piedmont; if I heard right the accident happen around 12:30-1:00p they should know about by 2:30p that they was going to be waiting engine from Washington on 91 they know 91 don't get in to Richmond until around 6p get into Raleigh around 9p, they should have had 74 crew to go fuel it up get back around so normal 79 could have ran the extra Piedmont called it either r79 or 1079,get a new crew together by 10p for 79 came into Raleigh by I think there should be policy if 79 running 3hrs or more late into Rocky Mount should run extra Piedmont on time 79 r79 or 1079.

3. Could Amtrak done things different, one side no because they had wait for engine& crew together. Other hand won't 91 give 79 tow into Raleigh then get engine one of the Piedmont engine to go to Charlotte, then have 19 to bring engine to Charlotte for 80. Although 91 doesn't stop at Wilson & Selma.

Umm...Just so you know, they put the down line passengers on buses to their destination so there was no need to run the extra Piedmont. Some were taxied to intermediate points. That decision was made earlier in the day. As for your drilling, it makes no sense. 91 was to leave an engine at RVR for 79 . They both arrived RVR within 3 minutes of each other at which point the new unit was added ahead.
 
Actually disrupting railroad operations. Which is what this would be under is a crime. And I want to say a felony. In Ohio this would either be a third or second degree felony charge. The sentence could go up to eight years. And if the prosecutor was really asking for it. You probably could throw in criminal trespass, attempted manslaughter, disruption of railroad operations, vandalism, among other charges. They could go away for a very long time. As they should.
